CPNeeds.com is operated by Johanna V. Kamerman, Esq. (Pennsylvania Bar #315641 / Florida Bar #27984). This privacy policy explains how we collect, use, store, and protect your personal information and protected health information (PHI).
2. Information We Collect
We collect the following categories of information:
- Contact Information: Name, phone number, email address
- Case Information: Child's date of birth, diagnosis, state where birth occurred, hospital name, description of events, whether you've spoken with another lawyer
- Medical Records: Documents you upload for our free medical record translation service
- Call Recordings: Conversations with our AI intake assistant Sofia are recorded
- Technical Data: IP address, browser type, device information, pages visited
- Marketing Data: UTM parameters, ad click IDs (gclid, fbclid), landing page, referral source
3. How We Use Your Information
- To evaluate your potential birth injury case
- To translate your medical records into plain language
- To contact you regarding your case review (with your consent)
- To send follow-up communications via email, phone, text, or WhatsApp (with your consent)
- To improve our services and website
- To comply with legal obligations
4. Protected Health Information (PHI)
We treat medical records and health-related information you provide as protected health information (PHI) under HIPAA. We maintain Business Associate Agreements (BAAs) with all third-party vendors who process, store, or transmit PHI on our behalf. PHI is only shared with vendors who have signed BAAs.
PHI Retention: Raw medical records are automatically deleted after processing. Sofia conversation transcripts are automatically deleted after 30 days. Case dossiers (containing analyzed information) are retained as long as necessary to serve your case.
5. AI Disclosure
We use artificial intelligence in the following ways:
- Sofia (Intake Assistant): An AI-powered voice assistant that gathers preliminary case information when you call. Sofia is not a human and not an attorney.
- Medical Record Analysis: AI assists in translating medical records into plain-language summaries. All AI-generated analysis is reviewed as part of the case evaluation process.
- Content Generation: Some educational content on our blog may be AI-assisted.
AI tools used for PHI processing are covered by BAAs and operate under HIPAA-compliant conditions.
6. Recording Disclosure
All phone calls to 1-800-CP-NEEDS may be recorded for quality assurance, training, and legal documentation purposes. By continuing a call after hearing the recording disclosure, you consent to being recorded.
7. Consent and Opt-Out
We only contact you with your explicit consent. When you check the consent box on our intake form, you agree to receive communications via phone, text, WhatsApp, and email. Each channel can be revoked independently:
- Text/WhatsApp: Reply STOP to any message
- Email: Click the unsubscribe link in any email
- Phone: Ask us to stop calling at any time
Consent is not required to receive your free medical records translation.
8. Data Sharing
We do not sell your personal information. We may share your information with:
- Attorneys: Birth injury attorneys who may handle your case, only with your knowledge
- Service Providers: Vendors who help us operate (email delivery, phone systems, cloud hosting) — all bound by BAAs where PHI is involved
- Legal Requirements: When required by law, subpoena, or court order
9. Data Security
We use industry-standard security measures to protect your information, including encrypted data transmission (TLS/SSL), secure cloud storage with access controls, and regular security audits. Our database enforces strict access controls and audit logging for all PHI transfers.
10. Cookies and Tracking
We use cookies and similar technologies for website functionality, analytics, and advertising. This includes Google Analytics and Google Tag Manager for measuring website performance, and conversion tracking pixels for advertising platforms. You can control cookies through your browser settings.
11. Children's Privacy
Our services involve information about children (the injured child). This information is provided by parents or legal guardians and is treated with the highest level of care and confidentiality. We do not knowingly collect information directly from children under 13.
12. Your Rights
Depending on your state of residence, you may have the right to:
- Request access to the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your information (subject to legal retention requirements)
- Opt out of marketing communications
